By using 1app.energy, you agree to these terms. Basically: don't abuse the system, and we aim to do our best to optimise your energy.
1. The Service
1app.energy provides software to monitor and control home energy devices. We use the API credentials you provide to send commands to your devices on your behalf.
2. User Representations & Age Restriction
By using the Service, you represent and warrant that:
- You are at least 18 years of age (The Service is not permitted for minors to control home hardware assets).
- All registration and API connection information you submit is true, accurate, and completely yours to provide.
- You will not access the Services through automated or non-human means, such as bots or automated scripts (scraping), unless via an officially documented API.
3. Acceptable Use
You agree not to:
- Reverse engineer, decompile, or attempt to extract our source code.
- Use the service for any illegal purpose.
- Share your account credentials with others.
- Spam our API, aggressively scrape data, or attempt to crash our servers (DDoS).
4. Third-Party Services & Hardware
External Dependencies
Our service relies on third-party platforms (e.g., Octopus Energy, Zappi, Solis). We do not control these services and are not responsible for their availability or performance.
Hardware Responsibility
We do not physically control your hardware. We are not responsible for electrical safety, installation compliance, manufacturer warranties, or physical faults. You remain fully responsible for the maintenance and safety of your equipment.
5. Device Control & Safety
Device Control Disclaimer
While the Service may send commands or configuration instructions to third-party devices, we do not guarantee successful execution, accuracy, or outcome. Users remain fully responsible for monitoring their systems and ensuring safe operation at all times.
6. No Energy or Financial Advice
The service provides automated optimisation tools only. It does not constitute energy, financial, or investment advice. You remain responsible for decisions relating to your energy usage and tariffs.
7. Intellectual Property & Submissions
Our Intellectual Property: We own or license all intellectual property rights in our Services, including source code, databases, functionality, software, and dashboard designs. We grant you a non-exclusive, non-transferable, revocable licence to access the Services for personal, non-commercial use.
Your Submissions:By sending us questions, comments, suggestions, ideas, or feedback ("Submissions"), you agree to assign us all rights in such Submissions. We shall be entitled to use and disseminate these ideas for any lawful purpose, commercial or otherwise, without acknowledgment or compensation to you.
8. Limitation of Liability
Liability Cap
To the maximum extent permitted by law, 1app.energy shall not be liable for any indirect, incidental, or consequential losses (including lost savings). Our total liability shall not exceed the fees paid by you in the 12 months preceding any claim.
This applies whether the claim arises in contract, tort (including negligence), or otherwise.
Important: Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any liability which cannot be excluded under English law.
Events Beyond Our Control
We are not liable for failure or delay caused by events beyond our reasonable control (e.g., power outages, internet failures, third-party service outages, acts of God).
9. Indemnification
You agree to defend, indemnify, and hold us harmless (including our subsidiaries, affiliates, and all of our respective officers, agents, partners, and employees) from and against any loss, damage, liability, claim, or demand, including reasonable attorneys' fees and expenses, made by any third party due to or arising out of:
- Your use or misuse of the Services.
- Your violation of these Legal Terms.
- Your breach of any third-party device manufacturer's warranty or terms of service resulting from your use of 1app.energy.
10. Subscriptions & Payments
Paid plans are billed monthly. You can cancel at any time via your dashboard. If you cancel, your access to premium features (like automated battery control) will end at the end of your current billing cycle.
11. Termination & Safety
We reserve the right to suspend or restrict access where necessary to protect system security, comply with legal obligations, or prevent harm. You may terminate your account at any time using the "Delete Account" feature.
12. Electronic Communications & Signatures
By using the Services, you consent to receive electronic communications from us. You agree that all agreements, notices, disclosures, and other communications we provide to you electronically satisfy any legal requirement that such communications be in writing.
You hereby agree to the use of electronic signatures, contracts, and electronic delivery of notices. You waive any rights requiring original signatures or non-electronic records.
13. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated via the service or email. Continued use of the service constitutes acceptance of the updated Terms.
14. Governing Law
Jurisdiction
These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
